Our client is seeking a highly accomplished and strategic Lead Intellectual Property Counsel to join their fully remote legal team. This senior role is responsible for managing and protecting the company's valuable intellectual property portfolio, including patents, trademarks, copyrights, and trade secrets. You will provide expert legal advice on IP strategy, transactions, and litigation, ensuring the company's innovations are adequately protected and leveraged. - Develop and execute the company's global intellectual property strategy.
- Manage the prosecution, maintenance, and enforcement of patents, trademarks, and other IP assets.
- Conduct freedom-to-operate analyses and advise on patentability of new inventions.
- Draft and negotiate IP-related agreements, including licensing, collaboration, and joint development agreements.
- Advise on trade secret protection strategies and implementation.
- Oversee and manage IP litigation, working closely with outside counsel.
- Conduct IP due diligence for mergers, acquisitions, and strategic partnerships.
- Educate and train internal teams on IP best practices and policies.
- Monitor the competitive IP landscape and identify potential risks and opportunities.
- Manage the IP budget and external legal spend effectively.
- Collaborate with R&D, marketing, and business development teams to align IP strategy with business objectives.
- Ensure compliance with all relevant IP laws and regulations in relevant jurisdictions.
- Manage a team of in-house and/or external IP professionals.
- Juris Doctor (JD) degree from an accredited law school.
- Admission to practice law in at least one relevant jurisdiction.
- Admission to practice before the relevant Patent Office (e.g., USPTO for patents).
- Minimum of 10 years of experience in intellectual property law, with a significant portion in-house or at a reputable law firm specializing in IP.
- Proven expertise in patent prosecution, trademark law, copyright law, and trade secret protection.
- Experience in IP licensing, transactions, and litigation.
- Strong understanding of patentability requirements and freedom-to-operate assessments.
- Excellent strategic thinking, analytical, and problem-solving skills.
- Exceptional negotiation, communication, and interpersonal skills, with the ability to influence stakeholders at all levels remotely.
- Proven ability to manage complex IP portfolios and projects.
- Experience in managing external counsel and budgets.
- Ability to work independently and effectively in a fully remote legal environment.
- Technical background in a relevant scientific or engineering field is highly advantageous.
